This night, Parliament definitively adopted the bill on compulsory vaccination and the extension of the health pass.

Already last week, the precious sesame was compulsory in “places of leisure and culture” gathering more than 50 people except 12-17 year olds, exempt from health pass until September 30, according to the agreement found. between deputies and senators.

From August, the health pass must be presented to cafes, restaurants, fairs and trade shows, to take the plane, train, long-distance bus or to access medical establishments, except in an emergency. . For shopping centers, the prefects will decide on a case-by-case basis.

Severe penalties

In case of non-compliance with the pass, penalties are provided: in transport for example, it will be a fine of 1,500 euros for the manager in the event of lack of control. In other places subject to the pass, such as bars and restaurants, failure to check the health pass will result in a formal notice and a 7-day closure. In the event of a repeat offense, the penalties can go up to one year of imprisonment and a fine of 9,000 euros for the managers.

As for employees, they will be required to have a health pass from August 30. Without this proof, they will be suspended without pay, or reassigned to positions not subject to the obligation of the pass, that is to say without contact with the public.

The use of an illicit pass will be punished by a fine of 135 euros.

Compulsory vaccination of caregivers

The bill also makes the vaccination of nursing staff compulsory, whether they work in hospitals, clinics or nursing homes. Professionals and volunteers working with the elderly, including at home, are also concerned.

This obligation will take effect on September 15. Until then, they may still test negative – and beyond that date if they have given a first injection. Professionals who refuse vaccination – unless there is a medical contraindication – will be banned from practicing, with suspension of salary, but not made redundant as provided for in the text initially.

New isolation measures

People who test positive for Covid-19 will have to isolate themselves for 10 days but this period may be shortened in the event of a negative test.

Health insurance will ensure the good isolation of people. In the event of non-compliance, the latter will be liable to a fine of 1,500 euros.

End of the pass in November?

This bill is based on the extension until November 15 of the transitional regime of gradual exit from the state of emergency, and not until December 31 as initially wished by the executive.

The health pass could therefore disappear from mid-November, if the epidemic situation allows it.
